While we're discussing our Founders, we should remember the Founders
who signed their real names to the Declaration of Independence. I
imagine they knew that the consequences of signing the Declaration
could be far worse than, say, an IRS audit. That knowledge still did
not "chill" them.

Now, I'm not suggesting that the threat of a criminal prosecution and
subsequent execution for treason are the only types of "harassment,
threats, and reprisals," that should qualify a donor for an exemption
from disclosure. But certainly our Founders' decision to publicly
attach their name to the Declaration of Independence should inform our
discussion about how extreme the "chill" should be before we allow
wealthy special interests to cloak themselves in secrecy.
