[EL] Santorum's term paper

Rick et al.,

I know that the election law field generally does not cover FERPA, but can any of you tell me why it is is OK for Santorum's former professor to provide his term paper to a reporter?  The date on that paper is 1980 and FERPA was enacted in 1974.

I admit to finding the quote entertaining, but I am more than a little troubled by the release of a student's coursework without his permission.
