The polls seem to show President Obama with a small but persistent lead
in Ohio, lowering the chances that we'll be waiting a couple of weeks
for the result of the election thanks to the state's scheduled delay in
counting provisional ballots. (They don't start counting those ballots
until Nov. 17.) It also means the chances of post-election litigation
over those wrong-precinct ballots probably won't matter for the
presidential election outcome. And that's a very, very good thing.
But Florida is a different story. Today comes word of two very
different polls

out of Florida, along with reports of lines stretching as long as3 or
more hours

in some parts of the state. It may be very close, even too close to call.
Heaven help us if the election comes down to Florida. And even if it
doesn't matter for the electoral college, but the margin is razor thin,
we could be looking at a situation where controversial changes in
election rules passed by the the state's Republican legislature over the
last few years, could make a difference to the outcome of the election.
I'll be writing about that possibility and a broader look at the
philosophical divide between Democrats and Republicans over the nature
of voting and how that plays into the voting wars in the cover piece in
tomorrow's Sacramento Bee California Forum

the campaign of sound and fury, signifying nothing.
This is my district and I've watched this race closely. With nothing
really of policy substance separating these two liberal Democratic
candidates, it has been an embarrassingly vacuous campaign about whether
Berman has taken too many foreign trips at taxpayer expense or Sherman
has engaged in self-dealing by making interest off his loans to the
campaign.
Berman has probably made a stronger case about effectiveness in his
leadership in Congress, but Sherman has made constituent service and
town meetings the cornerstone of his agenda, and polls have shown him
with the edge. The new district also has more former Sherman district
voters than Berman district voters. Unlike the last round of
redistricting, the new district was not drawn by the Congressman's brother.

With the polls deadlocked just a few days before Election Day, state
recount laws once again take on national significance. It is no
exaggeration to say that these laws could determine who is elected
president in 2012. This issue brief takes a look at some of the most
critical provisions of the recount laws in the 10 states identified as
most likely to be "tipping point" states that could provide the decisive
electoral vote in a close presidential contest (Colorado, Florida, Iowa,
New Hampshire, Nevada, North Carolina, Pennsylvania, Ohio, Virginia, and
Wisconsin). We also look at factors related to each state that could
increase the likelihood of bitter recount contests.
