By the way, in Pocan's proposed Amendment, all he needs to do with Section 2 is
remove two words to eliminate the structural problem he created.
The 15th and 19th Amendments gave congress the power to enforce.
Pocan's proposed Amendment gives congress the power to enforce AND IMPLEMENT.
After thinking about it, it is those two words "and implement" that really open
the door for usurping state administrative powers. Enforcing civil rights has
been an accepted part of federal practice, but implementing election-related
actions in all "public elections" arguably gives the feds the ability to
legislate procedures in not just federal elections, but all elections.
