Judge Randa discussed Younger abstention in his April 8 order denying the defendants' motions to dismiss, all of which argued that the doctrine applied.

Does anyone know why the opinion contains no discussion of Younger abstention?  Did the state officials not offer that defense?  The State of Oregon recently succeeded in having a similar case here dismissed by a U.S. District Court magistrate on that basis.
