    North Carolina Asks Chief Justice Roberts for Interim Immediate Stay

This morning I reported onan injunction 
<http://electionlawblog.org/?p=66308>just issued by the federal district 
court in the North Carolina voting case. The injunction was issued while 
the Supreme Court considers a stay of the 4th Circuit's order.

Well the state of North Carolina is not happy that the plaintiffs asked 
for this immediate injunction.They have filed this letter 
<http://electionlawblog.org/wp-content/uploads/nc-letter.pdf>, asking 
the Chief Justice to impose an immediate stay while the Court considers 
what to do with the stay request (response due Sunday at 5). They now 
want the stay to apply not just to the 4th Circuit's order but to the 
new district court injunction.

NC's stay request, which I think has a pretty good chance of being 
granted. An interim order from the Chief Justice could come today, 
although with it already being Friday afternoon on the East Coast 
perhaps this is not really necessary, especially because the district 
court has put implementation of the new injunction on the slow track.

In that interview, John Eastman pretty much suggests Section 2 of the 
Voting Rights Act is unconstitutional unless it is read to require proof 
of racially discriminatory intent (kind of defeats the whole point of

the federal district court requiring North Carolina to restore same day 
voter registration and the counting of out-of-precinct voting. The 4th 
Circuit had directed the district court to do that, reversing the 
district court's earlier refusal to do so. But....

North Carolina has appealed to the Supreme Court, and Chief Justice 
Roberts has indicated he wants a response on the emergency stay order by 
Sunday at 5 pm.  That order does not automatically stay anything. But....

Today's district court order puts things off until at least Tuesday: "IT 
IS FURTHER ORDERED that the parties appear before the court on Tuesday 
October 7, 2014, at 3:00 p.m. in Winston-Salem, Courtroom # 2 for a 
status conference to address how Defendants intend to comply with this 
Order."

By then, the Supreme Court could well have reversed the 4th Circuit's 
order, mooting the issue.

2003 could be useful in thinking about the Arizona redistricting case 
the Supreme Court has agreed to take.  Here is the abstract:

    Article I of the Constitution commits primary responsibility for the
    setting of time, place, and manner of congressional elections to the
    "legislature" of each state, a delegation mirrored in the
    presidential election context of Article II. Recently, questions
    have arisen about the meaning of this constitutional commitment, in
    Bush v. Gore's presidential election context and in the controversy
    over the Mississippi congressional redistricting, which the Supreme
    Court is hearing this term in Branch v. Smith. Ultimately, the
    question is whether the term "legislature" inherently delegates
    these powers only to the actual state legislature itself, or refers
    more generally to the state's legislative power, thus admitting of
    such mechanisms as executive veto, popular referendum, and equitable
    judicial intervention to fill legislative gaps. In answering this
    question, this Note examines the means used to define the term
    "legislature" in other constitutional provisions, and derives a test
    to evaluate the nature of the various constitutional delegations.
    This approach demonstrates that in the Article I context, any
    exercise of ex ante lawmaking would be valid, a finding that would
    legitimate judicial redistricting in the legislature's stead.
