“In Invisible World of Political ‘Donor Advisers,’ a Highly Visible

NYT:
<http://www.nytimes.com/2015/02/06/us/in-invisible-world-of-political-donor-advisers-a-highly-visible-player.html?smid=tw-share>

A constellation of left-leaning nonprofits and “super PACs
    <http://topics.nytimes.com/top/reference/timestopics/subjects/c/campaign_finance/index.html?inline=nyt-classifier>”
are raising tens of millions of dollars to pave the way for Hillary
Rodham Clinton’s presidential campaign — and nearly all of them have
paid Mary Pat Bonner a cut.

Over the past several years, the groups, which include American
Bridge 21st Century, Media Matters, and the super PAC Ready for
Hillary, have paid Ms. Bonner’s consulting firm in excess of $6
million to help them cultivate wealthy donors and raise money,
according to tax filings and campaign disclosures.

Ms. Bonner’s contracts give her firm a commission, typically 12.5
percent, on any money she brings in from her network of rich
    Democrats and liberals.

“Political Opportunity: A New Framework for Democratic Reform”
    <http://electionlawblog.org/?p=70120>

New
report<https://www.brennancenter.org/publication/political-opportunity-new-framework-democratic-reform>from
Mark Schmitt for Brennan/New America.

What should a useable framework for political reform achieve? First,
it should rest on an accurate description of what’s wrong with the
current political process. Second, it should lead to policy
responses that are achievable, if not today in the next five or 10
years, and that would also be effective. It should serve the dual
purpose of creating a plausible legal and constitutional
justification for policy, and conveying a clear and accessible story
about solutions for the public and policymakers. Finally, it should
not create further conflicts with rights to free expression, but
expand and enhance every person’s freedom to speak about issues and
    candidates.

There’s much I like in this report, though what Mark labels “political
opportunity” I would label political equality, of the “level up” variety.

“The Intratextual Independent ‘Legislature’ and the Elections
    Clause” <http://electionlawblog.org/?p=70117>

Northwestern University Law Review Online//is pleased
to announce its publication of Professor Michael Morley’s most
recent essay,/The Intratextual Independent “Legislature” and the
    Elections Clause
    <http://colloquy.law.northwestern.edu/main/2015/01/intratextual-legislatures.html>/.

In the essay, Professor Michael Morley assesses the Constitution’s
Elections Clause and how the Supreme Court might interpret the
clause in /Arizona State Legislature v. Arizona Independent
Redistricting Commission /(set for oral argument on March 2). The
case will decide whether an Arizona voter initiative vesting
congressional redistricting authority in an independent commission
rather than the state legislature violates the Constitution’s
Elections Clause. Morley employs “intratextualism” to interpret the
Elections Clause, carefully assessing the use of “legislature” in
other parts of the United States Constitution and founding-era state
constitutions. This analysis leads Morley to conclude that the
Arizona’s voter initiative is unconstitutional, because it
completely removes the state legislature’s congressional
    redistricting authority.

Ben Yagoda’s Lingua Franca column
<http://chronicle.com/blogs/linguafranca/2015/02/05/nice-going-genius/>in the
/Chronicle of Higher Education: /

In the slim annals of professorial humor, one of the cherished
entries concerns an anthropological linguistics conference where the
speaker declaims, “In languages all over the globe, one finds
examples of the double negative denoting affirmation, but never the
double positive denoting negation.” At which point a guy in the back
of the room stands up and says, “Yeah, sure.”

I’ve been pondering sarcasm since Adam Liptak’s recent/New York
    Times/article
    <http://www.nytimes.com/2015/01/20/us/scalia-lands-at-top-of-sarcasm-index-of-justices-shocking.html>about

Richard Hasen called “The Most Sarcastic Justice.” And just who
might that justice be? Hello! Duh! Spoiler alert!! It’s Antonin
Scalia. You were expecting maybe Ruth Bader Ginsburg????

Sorry, don’t know what came over me.
