In Shelby County v. Holder, the Court struck down an important
provision of the Voting Rights Act, section 4, on federalism
grounds. The Court argued that Congress no longer had the power to
enact section 4 because of the “federalism costs” imposed by the Act
and because the Act violated “basic principles” of federalism.
Unfortunately, the Court failed to articulate the costs to
federalism imposed by the Act, much less conduct a cost-benefit
analysis in order to determine whether the benefits of the Act
outweighed its costs. Moreover, the Court failed to discuss whether
the Reconstruction Amendments ought to matter at all to the
federalism debate. In this Essay, we ask three basic questions in
response to Shelby County. First, what does the Court mean by
“federalism costs,” and why have these costs undermined the
constitutionality of the VRA? Second, does the failure to discuss
Reconstruction and the Reconstruction Amendments undermine the
Court’s decision in Shelby County? And third, we ask how should we
understand the utility of federalism in the context of race and
voting. We suggest that if one purpose of federalism is that it
enables minorities to engage in self-rule, we should ask whether
federalism enables racial minorities to engage in self-rule.

In my decade-plus as an attorney at the Campaign Legal Center (CLC),
a nonpartisan legal organization, we’ve filed dozens of
administrative complaints with the Federal Election Commission (FEC)
against those we believed to be violating federal campaign finance
laws. Even in the best of times, we’ve waited in excess of 2 years
for the FEC to resolve our complaints. But things at the FEC have
gotten much, much worse in recent years.
Since 2011, we’ve filed 19 complaints with the FEC and only four of
them have been resolved. Six complaints that we filed in 2011-12
remain pending before the Commission. Until May 21, we had no idea
what has been causing delay. At the Commission’s May 21 public
meeting, however, we learned the likely source of delay when
Republican FEC Commissioner Lee Goodman acknowledged that he’s been
exercising his “discretion” to hold up complaints against Republican
and conservative groups.

The Federal Election Commission’s failure to resolve past
enforcement cases involving super political action committees is
likely to be targeted in a new round of legal actions by the
nonprofit Campaign Legal Center, the group’s senior counsel, Paul S.
Ryan, suggested.
The prospect for new lawsuits reflects frustration at FEC inaction
on legal and enforcement matters as the 2016 presidential election
cycle gears up while key campaign finance enforcement matters from
previous elections remain unresolved.
Ryan told Bloomberg BNA June 4 that his organization, which supports
strong campaign finance regulation through lawsuits and other
methods, will likely file a series of suits in federal district
court to force FEC action on administrative complaints that were
lodged with the agency as many as four years ago.
