A conservative group has filed a class-action lawsuit against the investigators and former state officials connected to a halted criminal investigation into Gov. Scott Walker’s 2012 recall campaign.

In the lawsuit, the John K. MacIver Institute alleges the investigators violated a 1986 federal law that protects electronic communications from illegal searches and seizures.

State and local election officials are bracing for another round of voter confusion after two federal judges struck down several voting-related laws recently.

Neither ruling will affect next week’s fall primary election, but they have potentially wide-ranging implications on the November vote for president, U.S. Senate and state legislative races, said Michael Haas, the state’s top elections administrator.

“Our main message at this point is that people understand that nothing changes these rules for the August election,” Haas said. “We, as well as the municipal clerks, will be doing our best to educate voters after the primary and as soon as we can.”

Chief executive Amy Dacey, Chief Financial Officer Brad Marshall and Communications Director Luis Miranda will leave the DNC just days after a new leader took the helm.

A trove of nearly 20,000 emails were posted on WikiLeaks last month. They included some emails that raised questions about the faith of Democratic presidential nominee Hillary Clinton’s primary rival, Sen. Bernie Sanders (Vt.), and others that seemed to disparage donors.

Thompson<http://electionlawblog.org/?p=83537>).”

The Ninth Circuit denied relief and now the candidate has petitioned Justice Kennedy<http://electionlawblog.org/wp-content/uploads/myers-petition.pdf> at the Supreme Court for emergency relief. The twist here is that this involves campaign speech in a judicial election.

Don’t count out the Court granting some relief in this case (see my piece, A Constitutional Right to Lie in Campaigns and Elections?<http://papers.ssrn.com/sol3/papers.cfm?abstract_id=2151618>). This is an issue that cuts somewhat across ideological lines.

RUCKER: What is your worry exactly?

TRUMP: I don’t like what’s going on with voter ID.

RUCKER: It would be what’s happening in the states?

TRUMP: Well, I think its ridiculous. I mean the voter ID situation has turned out to be a very unfair development. We may have people vote 10 times. It’s inconceivable that you don’t have to show identification in order to vote or that that the identification doesn’t have to be somewhat foolproof.

RUCKER: Although, there’s a tradition in this country of when somebody loses an election, they concede graciously and try to get their supporters on board like Al Gore did in 2000. Would you? You know if some reason Hillary were to win narrowly, would you contest that in some way?

TRUMP: I don’t want to jump the gun. I don’t want to talk about that. I’m just saying that I wouldn’t be surprised if the election . . . there’s a lot of dirty pool played at the election, meaning the election is rigged. I would not be surprised. The voter ID, they’re fighting as hard as you can fight so that that they don’t have to show voter ID. So, what’s the purpose of that? How many times is a person going to vote during the day? If you don’t have voter ID . . .

RUCKER: Do you think someone can vote multiple times?

TRUMP: Multiple times. How about like 10 times. Why not? If you don’t have voter ID, you can just keep voting and voting and voting.

RUCKER: Is there anything else that you think could be going on?

TRUMP: Look, you never know. It started with me in Louisiana when I won Louisiana and I got fewer delegates than Ted Cruz.

RUCKER: I remember that.

TRUMP: I said, “Whoa! Whoa! What happens here?” And then I polled well in Colorado. and instead of voting, the bosses picked it. I said, “What’s going on here?” It took me a little while to get accustomed to the world of politics and then once I did we started running them off. But, who would’ve thought that was going to happen? I win a state, I get fewer votes. Then, I poll great in Colorado and all of a sudden . . . the voters aren’t going to choose. The bosses are going to choose. Anything is possible.

Orthodox public administration separated politics from administration, leaving little room for campaigns. Subsequent work challenged orthodoxy’s premium on efficiency at the expense of democratic values. The constitutional school and interdisciplinary studies of transparency, administrative law, and political science provide alternatives. Yet public administration neglects campaign finance, even after major policy developments, including the Citizens United ruling. Examining classic and contemporary literature and policy developments, this article is the first to establish how the politics-administration dichotomy provides a framework for studying campaign finance.

A federal appeals court has blocked a rule banning so-called super PACs from naming their groups after candidates for office.

A three-judge panel of the D.C. Circuit Court of Appeals concluded that the Federal Election Commission appeared to have violated the First Amendment by prohibiting most uses of candidates in an unauthorized committee’s name, as well as in the names of “projects” such groups use to raise funds.

The decision<https://www.cadc.uscourts.gov/internet/opinions.nsf/BE823FAEEAD9111185258003005090F3/$file/15-5264-1628137.pdf> appears to break down another of the rather flimsy barriers between candidates and ostensibly unconnected super PACs supporting those candidates but raising donations in unlimited amounts. Candidates are already permitted to appear at fundraising events for those PACs, as long as they don’t personally solicit donations in excess of federal limits.

Given the conservative tilt in this panel, maybe the government will appeal to the full DC Circuit en banc?
