[EL] Trump and retaliation

I had a question based on the Politico story. We’ve discussed at length on this listserv the issue of private retaliation against political donors based on information gleaned from disclosure requirements. We have not discussed much the concept of government retaliation against political and ideological opponents based on the same or similar information the government mandates that people supply to it, although that was certainly a facet to the IRS scandal and the Wisconsin debacle.

Recalling the old Nixonian “enemies list” and the prospect of Donald Trump—a famously litigious and retaliatory private figure—in charge of the IRS and the Justice Department, I was curious if (i) pro-regulation commenters see the possibility of the government using such information to target and harass political or ideological enemies as a problem, and (ii) what steps people have proposed to try to prevent this from happening in an environment where much political activity must be reported to the government. Outside of Rick’s book, I cannot seeing pro-regulation writings that address this argument, so I am curious as to whether, or to what extent, this has been addressed.

Texas’ highest criminal court tossed the second and final felony charge against former Gov. Rick Perry on Wednesday, likely ending a case the Republican says helped sink his short-lived 2016 presidential bid.

The Texas Court of Criminal Appeals dismissed the abuse-of-power charge, which was filed after Perry threatened — and then carried out — a veto of state funding for a group of public corruption prosecutors after the Democratic head of the unit refused to resign.

According to P.P.P., 70 percent of Mr. Trump’s voters in South Carolina wish the Confederate battle flag were still flying on their statehouse grounds. (It was removed last summer less than a month after a mass shooting at a black church in Charleston.) The polling firm says that 38 percent of them wish the South had won the Civil War. Only a quarter of Mr. Rubio’s supporters share that wish, and even fewer of Mr. Kasich’s and Mr. Carson’s do.

Nationally, the YouGov data show a similar trend: Nearly 20 percent of Mr. Trump’s voters disagreed with the freeing of slaves in Southern states after the Civil War. Only 5 percent of Mr. Rubio’s voters share this view.

A federal judge has turned down a request to block a federal official’s move allowing three states to enforce proof-of-citizenship requirements for people attempting to register as voters.

U.S. District Court Judge Richard Leon declined to issue the temporary restraining order civil rights and voting rights groups sought<http://www.politico.com/blogs/under-the-radar/2016/02/voting-rights-citizenship-proof-219642> to block approval of changes the states of Alabama, Kansas and Georgia obtained recently to a federal form that can be used in lieu of state voter registration applications.

“Given that the registration deadlines for the Alabama and Georgia primaries and for the Kansas Republican Caucus had already passed at the time this TRO motion was filed…and that the effects of [the federal] actions on the ongoing registration process for the Kansas Democratic Caucus and plaintiffs’ rights and efforts thereto are uncertain at best, plaintiffs have not demonstrated they will suffer irreparable harm before the hearing on their Motion for a Preliminary Injunction,” Leon wrote in a four-page order issued Tuesday afternoon<http://www.politico.com/f/?id=00000153-1045-d7cd-af53-18ff0e630000>.
