To refuse to vacate would create a political nightmare. The law is as the law is today. If a court wants to invalidate it or the legislature wants to change it, that would be for some future application. As I wrote earlier, the quickest and easiest fix for this is through the legislature, where it could be done by year’s end, not in the courts, where it could take years. Without intending to get into the wisdom of the California recall system (which is indeed quite doubtful), let me suggest that a refusal of Gov. Newsom to vacate his office if a majority of voters vote for his recall would raise for many people, particularly Trump supporters, questions of legitimacy. If I had more time today, I'd refine my comment. Please take it as a tentative suggestion that a refusal to vacate office would create serious difficulties.
