Professor Foley’s essay on Trump’s potential ineligibility is fascinating,
though it seems to me that Trump himself has already disqualified himself
from being elected in 2024. The 22nd Amendment prohibits anyone from being
*elected* more than twice. If Trump claims to have been elected, but not
allowed to serve, in the 2020 election, that would make him ineligible to be
elected again, according to a plain reading of the Constitution.
