Update: I stand corrected! The Assembly’s defense counsel did raise a version of the independent state legislature theory in its brief<https://urldefense.com/v3/__https://electionlawblog.org/wp-content/uploads/234-3_21-Assembly-Memo-Opposition.pdf__;!!CzAuKJ42GuquVTTmVmPViYEvSg!O5r4fXd4w917lQe033C7X-Wc57ZN_q7hkKqhplO07yULp6vG4uZiUG8PY-ObGbrz65gT1AEbAUcEi_Fpw_g_0w$ >:

You can find the ruling at this link.<https://urldefense.com/v3/__https://electionlawblog.org/wp-content/uploads/ny-gerrymander.pdf__;!!CzAuKJ42GuquVTTmVmPViYEvSg!O5r4fXd4w917lQe033C7X-Wc57ZN_q7hkKqhplO07yULp6vG4uZiUG8PY-ObGbrz65gT1AEbAUcEi_G_whmNgQ$ >

The ruling can still be appealed to NY’s highest appellate court.

Anyone expect Democrats to raise the independent state legislature doctrine, arguing that the NY legislature can draw whatever maps it wants for congressional districts unencumbered by the state constitution? I didn’t think so.
