Food, Beverage, and Consumer Products Litigation

Care about what's in your food? Care about consumer rights? We are here. Our class covers consumer litigation against food, beverage, and consumer goods companies challenging labeling, marketing, and related consumer deception claims.

We will travel down a road map of class actions - from pre-suit investigation and filing through class certification, dispositive motions, and trial. Along the way, we cover key legal issues that shape these cases, including the statutory framework consumer protection statutes, the "reasonable consumer" standard, standing and injury, and the role of experts. We also cover key defenses, such as federal preemption, reliance and causation, and Rule 23 certification issues.

We will explore how regulatory regimes intersect with private litigation.

We stay practical and grounded and bring to you topflight practitioners who bring and defend these claims.

Grading will be based on class participation and a final paper, which may fulfill the SAW requirement. This seminar is particularly appropriate for those interested in consumer protection law, class action litigation, public health, and regulation. There are no prerequisites except a willingness to participate actively and challenge us and our guest lectures.
